General Terms and Conditions

1. General Information

These General Terms and Conditions (hereinafter referred to as GTC) are an integral part of all contracts concluded between you and us, the steirischer herbst festival gmbh (FN 263904w, Sackstraße 17, 8010 Graz, Austria). Our GTC apply to the sale as well as the provision of admission tickets, festival passes, merchandize and other items free of charge in all our permanent and temporary sales outlets as well as in our online shop and partner webshops. For all deliveries and/or services as well as for offers and payments made by steirischer herbst festival gmbh or to steirischer herbst festival gmbh, the present GTC shall apply exclusively, unless the contracting parties have expressly agreed otherwise in writing. The GTC also apply if you attend one of our events free of charge.

These GTC can be accessed at any time on the Internet at www.steirischerherbst.at/en/pages/989/terms-and-conditions.

You agree to these GTC when you place an order or attend an event. The online sale of festival passes and tickets takes place via our external affiliate or partner webshop. The General Terms and Conditions of our sales partner, CTS Eventim Austria GmbH, Heumühlgasse 11, 1040 Vienna, Austria (oeticket), also apply. The sales partner arranges the tickets or the festival pass on behalf of and for the account of the respective organizer.


2. Prices, payment, delivery and shipping costs

All prices are in EURO incl. VAT.

We accept cash payment at our points of sale as well as electronic payment at our POS terminals (China Union Pay, JCB, Maestro, Mastercard, Visa, V-Pay, American Express, Diners Club/Discover). In exceptional cases, we may not be able to offer electronic payment at some temporary points of sale due to technical or organizational reasons.

Once the order is completed in our online store, an immediate payment checkout takes place via our payment system provider Stripe (Stripe Payments Europe Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland). The payment methods accepted can be seen at the end of the order process. Credit card payment and online bank transfer are accepted. The payment methods offered are subject to change without notice.

We manually review and process each order, which may result in a processing time of several business days. Upon receipt of your order, we will endeavor to ship it within a maximum of five business days. Shipping charges are flat rate shipping and handling charges and are based on the shipping destination specified when the order is placed. All costs incurred can be seen in the shopping cart before the order is finally placed. Any eventual import duties in the recipient country are at your expense and will not be reimbursed by us.

If the goods cannot be delivered and are returned to us by the shipping service provider because you provided incorrect address data during the ordering process or you are otherwise culpably in default of acceptance (e.g. by not picking up shipments deposited for you), we are entitled to charge you for any additional expenses incurred.

You are not entitled to legally assign any claims you may have against us.


3. Right of return, revocation or withdrawal from the contract

Please refer to the information in the cancellation policy (Annex 1) enclosed with these GTC for information on your right of withdrawal as a consumer in the case of contracts concluded with us at a distance (e.g. in the online store). You can exercise your right of revocation, for example, by completing the revocation form provided (Annex 2).

The purchase of festival passes or tickets in our partner webshops is excluded from the right of revocation in accordance with Section 18 paragraph 1 line 10 of the Austrian Distance Selling Act (FAGG).

The return of tickets is only possible if the corresponding event is cancelled or postponed. In this case, the return of the ticket will be carried out by the respective (partner) point of sale. Alternatively, you can return the ticket directly to us no later than one month after the scheduled date of the event. The return of the personalized festival pass is not possible. In case of cancellation, postponement or change to the program, no expenses of any kind (such as hotel or travel expenses, etc.) will be reimbursed. We will not reimburse you for any agency, system or processing fees.


4. Festival pass, entrance tickets

The Festival Pass is not offered in every Festival edition.

The Festival Pass is non-transferable and only valid in combination with a current photo ID. With the purchase of a Festival Pass, you are generally granted admission to all events of steirischer herbst festival gmbh during the period indicated on the Festival Pass. Admission, however is subject to capacity restrictions. This especially applies to events that are explicitly stated in the program booklet or on our website as having limited capacity. For these, we recommend making a reservation in good time, for which there is an extra charge.

A claim to performance in connection with admission tickets only exists for services provided by us. We do not guarantee the provision of any additional services provided by third parties as these may change due to the cooperation partner in question. In addition, we reserve the right to make changes to the program. The access control upon entering the venue can determine how often during the festival you attend certain events.

Admission tickets and festival passes are not considered invoices in the sense of Section 11 of the Austrian Value Added Tax Act (VAT) and so do not entitle the holder to deduct input tax.


5. House rules, late admission

Attendance at our events is conditional upon accepting the house rules in force at the respective venue. The applicable house rules are posted in the entrance area of the venue or can be viewed on the website of the respective operator.

Proof of discounts may be checked at the time of admission. At all venues, late arrivals are subject to the admission regulations of the respective house rules. A ticket is invalid unless it is torn off. Upon leaving the venue, the ticket loses its validity. Abuse will be punished.

Open-air events can be held in all weathers. No umbrellas, bottles or other dangerous objects may be taken into the event area. You are responsible for providing yourself with clothing suitable for the weather.

You may be excluded from the event for good cause, in particular if you endanger employees or other visitors to the event or cause them more than a tolerable level of inconvenience. If the right of exclusion is exercised, the ticket loses its validity or the Festival Pass loses its validity for this event. Should good cause arise again, the Festival Pass will lose its validity in its entirety. In such cases, a claim for renewed admission or for a refund of the purchase price is excluded.


6. Liability/compensation

The steirischer herbst festival gmbh is liable for damages caused by intent or gross negligence. Liability for ordinary negligence is excluded, with the exception of personal injury and breaches of main contract obligations.


7. Image and sound media

You are not permitted to make visual, audio or film recordings at events. If you fail to comply with this prohibition, we are entitled to exclude you from further participation in the event. Alternatively, you have the right to leave the recording device with us. We will issue you with an acceptance ticket and, in exchange for the acceptance ticket, return the recording device to you when you finally leave the event. We reserve the right to prosecute the unlawful production of image, sound and film recordings or the use such.

9. Place of performance, choice of law and place of jurisdiction

The place of performance for all contractual points is Graz. Austrian law shall apply to all contracts concluded. The application of the UN Convention on Contracts for the International Sale of Goods is excluded. It is agreed that the Regional Court of Graz shall be the exclusive competent court for disputes.

Complete revocation instructions

1. Right of revocation

You have the right to revoke this contract within fourteen days without giving any reason.

The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the goods.

a clear statement (e.g. a letter sent by mail or email) about your decision to revoke this contract. You can use the enclosed sample revocation form for this purpose, but it is not mandatory.

In order to comply with the revocation period, it is sufficient to send the notification of the exercise of the right of revocation before the expiry of the revocation period.

2. Consequences of the revocation

If you revoke this contract, all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), will be refunded to you immediately and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. We will use the same means of payment for this repayment that you used for the original transaction, unless you have expressly agreed otherwise; under no circumstances will you be charged for this repayment.

We may refuse to refund you until such time as we have received the goods or until you have provided proof that you have returned the goods, whichever is the earliest.

You must return or hand over the goods to us immediately at the latest within fourteen days from the day on which you notify us of the revocation of this contract.

The deadline is met if you return the goods before the expiry of the fourteen-day period.

You are responsible for the direct costs of returning the goods.

You only have to pay for any loss in value of the goods should this loss in value be due to the handling of the goods which was not necessary for the inspection of the quality, characteristics and functioning of the goods.
